Are you 'irreplaceable'? Abusing medical leave is one way to find out!

In a recent case, an employee who was terminated following her attendance at a Beyoncé concert while out on Family and Medical Leave Act (FMLA) leave argued that she was fired in retaliation for her taking medical leave. Her employer denied that its actions were retaliatory in nature, claiming instead that she was fired because it suspected she was taking medical leave when she wasn't sick. The U.S. 5th Circuit Court of Appeals (whose decisions apply to Mississippi, Louisiana, and Texas employers) agreed, finding that the termination wasn't retaliatory in nature. Let's take a look.
