Louisiana Legislature expands medical marijuana law

Last spring, we reported on Louisiana's new medical marijuana law and the obstacles it presents for employers with drug-testing programs (see "High alert: Medical marijuana comes to Louisiana" on pg. 3 of our April 2018 issue). Our previous article surmised that you should proceed cautiously when disciplining employees who fail a drug test for marijuana and then furnish a "recommendation" for medicinal marijuana from a duly licensed physician. The rationale for that advice was that Louisiana's specific and exhaustive list of marijuana-treatable conditions likely bestows on employers constructive knowledge that an employee who possesses such a recommendation suffers from a disability.
