Heed the WARNing signs: an exception to layoff notification law

A recent decision by the U.S. 3rd Circuit Court of Appeals (whose rulings apply to all New Jersey employers) helps explain a key exception to the federal Worker Adjustment and Retraining Notification (WARN) Act. Although this is welcome news for New Jersey employers, it remains unclear whether the exception would apply under the state's own layoff notification law.
