I was wondering if there is a law or policy that determines how long one must keep Applications and Resumes on file. Is this something that is up to the Company to decide their own policy, or do I need to keep them for a particular length of time for EEOC protection, etc?
Any help would be greatly appreciated. Thanks, Scott P. |

It depends if they were solicited or unsolicited. Federal records retention for ADEA say one year for solicted. AAP (Affirmative Action)or executive order 11246 requires two years for solicited applications. You only have to meet the federal AAP retention schedule if you have federal contracts. Unsolicited we destroy after 6 months. All others we keep for two years.

Is there a website that might list this information? I have tried Dept of Labor and EEOC, but cannot find anything on the topic. Thanks for the help so far x:-)

You are generally pretty safe with two years for solicited resumes. Those are resumes and applications that are for positions that are open and you are actively recruiting for. Two years generally covers all the discrimination scenarios that you might be sued under. I would check to see if your state has any special statutes that would extend the time to file a lawsuit. Try the Commission for Human Rights and Opportunities (CHRO).

Hey Sam, I just sent it over to you with out a cover sheet. There should be two pages. The top of the first sheet reads "Federal Records Retention Chart".
